UACT members: empower ourselves with a knowledge of tenants’ legal rights disclose individual landlords’ track records  share tenant reviews of local landlords and rental units  connect renters with local resources Our Members United Athens County Tenants Members should be either: Tenants or those unhoused in Athens County or surrounding counties in SE Ohio. Individuals who have specific knowledge in tenant rights, or with an expressed history or interest in tenant organizing, regardless of homeownership status.  United Athens County Tenant Members will not be: Individuals who own or manage rental properties anywhere.  Ideally, membership of UACT will always be in the majority hands of tenants, with no more than a ⅔ to ⅓ split of tenants to homeowners at any given time (giving tenants the supermajority). Exceptions can be discussed on a case by case basis.</image:caption>

      <image:caption>Service Animals: Even if pets/animals are not permitted in a unit, service animals are allowed. In order to be considered a service animal and protected by law: The person with the service animal must have a “disability,” which is defined as "disability" is defined by the Fair Housing Act as "mental or physical impairments that substantially limit one or more major life activities.” The term mental or physical impairment may include conditions such as blindness, hearing impairment, mobility impairment, HIV infection, mental retardation, alcoholism, drug addiction, chronic fatigue, learning disability, head injury, and mental illness. The term major life activity may include seeing, hearing, walking, breathing, performing manual tasks, caring for one's self, learning, speaking, or working. The Fair Housing Act also protects persons who have a record of such an impairment, or are regarded as having such an impairment. Current users of illegal controlled substances, persons convicted for illegal manufacture or distribution of a controlled substance, sex offenders, and juvenile offenders are not considered disabled under the Fair Housing Act, by virtue of that status. Fair Housing Act, 42 U.S.C. 360, et seq. (https://www.justice.gov/crt/fair-housing-act-2) The tenant with the service animal must submit to their landlord a letter affirming that the tenant has a disability, preferably with documentation from their doctor, therapist or other medical provider verifying the need for a service animal. The landlord or other provider of housing is entitled to obtain only that information necessary to determine whether the requested accommodation is necessary because of a disability. So the tenant doesn’t need to provide a detailed or comprehensive medical history. A landlord can refuse this requested accommodation if it would constitute an undue financial or administrative burden or would fundamentally alter the nature of the housing; for example, if the animal is disruptive to other tenants, or if the animal poses a direct threat to the health, safety, or property of others. Private housing landlords cannot charge a fee or security deposit for a service animal. However, the tenant may still be financially liable for damages caused by the service animal. Service Animals in Public Housing: Other federal laws may apply as well, including Section 504 of the Rehabilitation Act of 1973, which requires any program receiving federal assistance to provide reasonable accommodations to persons with disabilities, such as public or subsidized housing, although not a landlord who only accepts Section 8 rental assistance. Regardless, the Fair Housing Act applies to virtually all forms of housing. Public housing landlords cannot charge a fee or security deposit for a service animal. However, the tenant may still be financially liable for damages caused by the service animal.</image:caption>

      <image:title>Conditions and Rental Suitability - Landlord duties: (1) Comply with the requirements of all applicable building, housing, health, and safety codes that materially affect health and safety; (2) Make all repairs and do whatever is reasonably necessary to put and keep the premises in a fit and habitable condition; (3) Keep all common areas of the premises in a safe and sanitary condition; (4) Maintain in good and safe working order and condition all electrical, plumbing, sanitary, heating, ventilating, and air conditioning fixtures and appliances, and elevators, supplied or required to be supplied by the landlord; (5) When the landlord is a party to any rental agreements that cover four or more dwelling units in the same structure, provide and maintain appropriate receptacles for the removal of ashes, garbage, rubbish, and other waste incidental to the occupancy of a dwelling unit, and arrange for their removal; (6) Supply running water, reasonable amounts of hot water, and reasonable heat at all times, except where the building that includes the dwelling unit is not required by law to be equipped for that purpose, or the dwelling unit is so constructed that heat or hot water is generated by an installation within the exclusive control of the tenant and supplied by a direct public utility connection; ORC 5321.04 (http://codes.ohio.gov/orc/5321.04) Escrow IF you think that your landlord has violated their obligation to keep the premises liveable/habitable, DO NOT stop paying rent. If you stop paying rent because your landlord will not fix or repair the premises, or because your landlord has violated the lease agreement, you are still liable for rent and could face eviction for nonpayment.
